1. Scope
MoodRx LLC ("MoodRx," "we," or "us") operates moodrx.com (the "Site") to provide information about outpatient mental health therapy delivered by telehealth to eligible patients located in Pennsylvania and to help people contact our practice. This Website Privacy Policy describes our handling of information collected through the public Site and ordinary administrative inquiries. It does not replace our HIPAA Notice of Privacy Practices, which describes our use and disclosure of protected health information ("PHI") in connection with patient care. If this policy and the HIPAA Notice address the same PHI, the HIPAA Notice and applicable law control.
2. Information We Collect
Depending on how you interact with the Site, we may collect:
- Contact information you choose to provide, such as your name, phone number, and the content of your inquiry.
- Information you voluntarily provide when requesting information about appointments or care. Please do not submit detailed clinical or emergency information through ordinary public-site contact fields.
- Basic technical information needed to operate and protect the Site, such as an IP address, browser and device type, referral and page information, access timestamps, and security logs.
- Information needed to respond to accessibility or privacy requests.
These categories are limited to the Site and actual MoodRx administrative activities. Patient registration, clinical records, insurance and payment information may be collected and processed through separate clinical systems in connection with care, subject to the HIPAA Notice and applicable law.
3. How We Use Information
We use information as reasonably necessary to maintain and secure the Site; respond to inquiries; communicate about scheduling, eligibility, and administrative questions; direct patients to appropriate clinical intake systems; investigate misuse or security incidents; comply with law; and maintain ordinary records of these activities. We do not use information submitted for a request for care as a source of advertising audiences or behavioral advertising profiles.
4. Cookies, Analytics, and Tracking
The Site and its infrastructure may use cookies and similar technologies needed for basic operation, security, fraud prevention, and limited website performance measurement. We do not authorize analytics or advertising technologies to receive PHI unless their use and disclosure comply with HIPAA and any other applicable privacy requirements. A public-site privacy notice does not, by itself, authorize disclosure of PHI to an analytics or advertising vendor.
5. Who May Receive Information
We disclose information only when reasonably necessary and legally permitted, including to providers supporting Site hosting, security, communications, and related operations; to clinicians or administrative staff handling your inquiry; to parties you direct us to contact; or when permitted or required by applicable law. When a vendor handles PHI for MoodRx as a HIPAA business associate, we require appropriate safeguards and a business associate agreement when required by law.
The appearance of a link to another organization, including an affiliated practice, does not mean that MoodRx automatically discloses your patient information to that organization. Patient information is shared only under an applicable legal basis, including authorization when required.
6. Patient Health Information
Information related to your treatment, appointments, diagnoses, clinical records, and insurance claims may be protected by HIPAA and Pennsylvania confidentiality law. Those records are governed by the HIPAA Notice of Privacy Practices, patient intake documents, and applicable law. To discuss clinical matters or transmit clinical records, use communication methods approved by our practice rather than ordinary public website forms. We may need to verify identity before acting on a request concerning patient records.
7. Information Sales and Advertising
MoodRx does not authorize the sale of patient PHI or its disclosure to third parties for targeted advertising. Any use or disclosure of PHI requiring authorization will occur only with a valid authorization or other lawful basis.
8. Retention and Security
We retain website and administrative information only as long as reasonably needed for its purpose and to satisfy applicable legal, operational, security, and recordkeeping requirements. Patient records are retained under applicable clinical recordkeeping obligations and are not subject to automatic deletion on request. We use administrative, technical, and physical safeguards appropriate to the information and our operations. No transmission or storage system is risk-free, and we do not guarantee absolute security.
9. Your Choices and Requests
You may contact us to request information about, or correction of, personal information that we maintain, subject to identity verification and applicable law. Rights regarding PHI, including rights of access, amendment, restrictions, confidential communications, and accounting of disclosures, are described in our HIPAA Notice. Additional state-law rights, when applicable, will be honored. The rights of minors, parents, and legal representatives are governed by applicable law.
10. External Sites and Clinical Portal
The Site may link to third-party websites and to the separate patient portal. Other organizations' websites have their own practices. A link does not endorse a third party's practices. Patient-care information handled on behalf of MoodRx by a clinical technology provider remains subject to applicable privacy and security obligations.
11. Changes to This Policy
We may revise this policy when our practices or legal requirements change. We will publish the updated policy and effective date. Any additional notice required by law will also be provided.
